WRIT PETITION No.23278 OF 2021
ORDER:
Heard the learned counsel for the petitioner and the learned
counsel appearing for the respective respondents, except respondent
No.6, whose appearance is not entered, despite the service of notice.
Learned counsel for the petitioner after arguing the matter at
length, submits that the petitioner would approach the concerned
authority under Payment of Gratuity Act and therefore, would not to
pursue the present Writ Petition.
In view of the said submission, the Writ Petition is disposed of
leaving it open to the petitioner to seek appropriate remedies under
Payment of Gratuity Act before the concerned authority and in the event
of the same, the authorities concerned shall pass appropriate orders
strictly in accordance with law, after giving due opportunity to the 6th
respondent and also keeping in view the relevant precedents including
the Judgment of the Hon'ble Supreme Court in Birla Institute of
Technology vs. The State of Jharkhand & Ors in Civil Appeal No.2530 of
2012, dated 07.03.2019.
Accordingly, the Writ Petition is disposed of with the above
directions. There shall be no order as to costs.
As a sequel, miscellaneous applications, pending, if any, shall also
stand closed.
