Petition under Section 397(1) of Cr.P.C. praying that 'in the circumstances stated in the grounds filed in the Crl.R.C., the High Court may be pleased to suspend the conviction and sentence imposed in the judgment dated' 06.03.2017 in C.C.No.111 of 2016 on the file of the court of learned Judicial Magistrate of First Class, Special Mobile Court, Eluru, West Godavari District, as was confirmed by the Judgment Dated 26.04.2021 passed in Crl.A.No. 95 of 2017 on the file of the court of learned District & Sessions Judge, Eluru direct the learned District & Sessions Judge, Eluru .court to continue on bail in the criminal appeal, pending disposal of Crl.R.C. No.- 359 of 2021 on the file of High Court.

The petition coming on for hearing, upon perusing the Petition and the grounds filed in Cri.RC., and upon hearing the arguments of Sri Eluru Sesha Mahesh Babu, Advocate for the Petitioner, and of Public Prosecutor for Respondent-State, the Court made the following ORDER:-

"Heard.

The sentence of imprisonment passed in judgment dated 26.04.2021 against the petitioner/ accused in Criminal Appeal No.95 of 2017 on the file of | Additional District and Sessions Judge, West Godavari District, Eluru modifying ~ the judgment dated 06.03.2017 passed in C.C.No.111 of 2016 on the file of Judicial Magistrate of First Class, Special Mobile Court, West Godavari, Eluru, alone is suspended pending the criminal revision case on condition of petitioner surrenderring before the Judicial Magistrate of First Class, Special Mobile Court, West Godavari, Eluru and on such surrender, the petitioner snall be released on bail on the same day on his executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties each for a likesum to the satisfaction of the learned Judicial Magistrate of First Class, Special Mobile Court, West Godavari, Eluru."
