Petition under Section 389 (1) of Cr.P.C. praying that in the circumstances stated
in the affidavit filed in support of the petition, the High Court may be pleased to suspend
the payment of compensation of Rs.1,00,00,000/- (Rupees One Crore Rupees lakh
only) dt.08.07.2019 passed in C.C.No.139 of 2013 on the file of the Special Judicial
Magistrate of First Class (For Prohibition & Excise), Kurnool, Kurnool District, which was
confirmed in CRL.A.No.135 of 2019 on the file of the Sessions Judge, Kurnool, Kurnool
District dt.03.11.2020, pending disposal of CRLRC No.216 of 2021, on the file of the
High Court. .
The petition coming on for hearing, upon perusing the Petition and the affidavit
filed in support thereof and upon hearing the arguments of SRI.D PURNACHANDRA
REDDY Advocate for the Petitioners and of PUBLIC PROSECUTOR for Respondent
No.2, the Court made the following
ORDER:
"Heard.
The sentence imposed in judgment dated 03.11.2020 against the
petitioner/A2 in Criminal Appeal No.135 of 2019 on the file of Sessions Judge,
Kurnool, confirming the judgment dated 08.07.2019 passed in C.C.No.139 of 2013
on the file of Special Judicial Magistrate of First Class (for Prohibition and
Excise), Kurnool, alone is suspended pending the criminal revision case on
condition of petitioner surrenderring before Special Judicial Magistrate of First
Class (for Prohibition and Excise), Kurnool and on such surrender, the
petitioner/A2 shall be released on bail on the same day on her executing a bond
for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties each for
a likesum to the satisfaction of the learned Special Judicial Magistrate of First
Class (for Prohibition and Excise), Kurnool. The petitioners shall deposit 20% of
the cheque amount i.e. Rs.20,00,000/- (Rupees twenty lakhs only) before the trial
Court within eight weeks from the date of receipt of a copy of this order.
