Petition under Section 151 CPC praying that in the circumstances stated in the
affidavit filed in support of the writ petition, the High Court may be pleased to direct the
4° respondent to delete the names of the unofficial respondents by incorporating the
petitioners names in the revenue records i.e 4-B,Adangal and pattadar pass book in
respect of land in Sy.No. 656/1B to an extent of Ac. 4.00 cents situated at Vepulabailu
Village of Piler Mandal, Chittoor District, pending disposal of WP No. 5063 of 2021, on
the file of the High Court.
The court while directing issue of notice to the Respondents herein to show
cause as to why this application should not be complied with, made the following
order.(The receipt of this order will be deemed to be the receipt of notice in the case).
ORDER
Heard the learned counsel for the petitioners and learned Assistant
Government Pleader for Revenue who seeks time to secure instructions in the
matter.
However, considering the submissions made by the learned counsel for
the petitioners that the revenue records in respect of the subject matter property
was mutated in favour of the respondents, without issuing notice to the
petitioners and that the same is contrary to the judgment of Full Bench reported
in 2007(6) ALD 134, there shall be a direction to all the parties in the writ petition
not to take any steps which would frustrate their respective claims, with regard to
the property in question on the basis of he entries in the revenue records, for a
period of eight (8) weeks.
