                   the appellant-applicant.
                         Also heard Mr. Srinivasa Reddy, learned Public
                   Prosecutor appearing for the respondent.

The appellant-applicant has been in prison for 5 years and 5 months. He made a prayer for bail in view of judgment of the composite High Court of Judicature at Hyderabad for the States of Telangana and Andhra Pradesh in Batchu Ranga Rao & Others v. The State of A.P., rep. by its Public Prosecutor, reported in 2016(3) ALT (Crl.) 505 (A.P).

Mr. Srinivasa Reddy, learned Public Prosecutor, submits that the conduct of the appellant-applicant in jail is satisfactory.

We have considered the materials on record. We note that the case of the appellant-applicant does not fall within the exceptions carved out in Batchu Ranga Rao (supra).

Taking note of the fact that the appellant-applicant has suffered more than five years' period of detention from the date of his conviction and there is no immediate possibility of the appeal being heard and that the conduct of the appellant-applicant in jail being satisfactory, we are inclined to suspend the sentence of imprisonment imposed on the appellant-applicant and enlarge him on bail in view of the directions contained in Batchu Ranga Rao (supra).

Accordingly, the sentence of imprisonment imposed on the appellant-applicant is suspended and he shall be enlarged on bail on executing a personal bond for a sum Sl. DATE ORDER OFFICE No. NOTE

of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for the like sum each to the satisfaction of the Superintendent, Central Prison, Visakhapatnam. The appellant-applicant shall appear before the trial Court once in a month till disposal of the appeal, failing which, the trial Court shall submit a report to this Court, whereupon the bail granted to the appellant-applicant shall stand cancelled, in accordance with law.

With the above directions, this application stands disposed of.
