Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be pleased to
issue a writ, Order, or Direction more particularly one in the nature of Writ of
Mandamus, declaring the action of the respondent.No.2 in evaluating the answer scripts
of the petitioner through digital evaluation process for the examination conducted for the
two subjects Le., Pathology and Forensic Medicine of the M.B.B.S i] year without
complying the procedure as prescribed by MCI and also as per directions of this Hon'ble
court in earlier judgments and thereby declaring the results of the said two subjects as
illegal, arbitrary, unjust, malafide, against to the fundamental rights guaranteed under
the constitution and against to the settled principies of law and to consequently direct
the respondents to evaluate the petitioner's two subjects j.e., Pathology and Forensic
Medicine of the M.B.B.S ll year which was held in the month of March 2021 and to
evaluate the same as per law strictly monitoring the evaluation process free from any
discrepancies: --

Petition under Section 151 CPC praying that in the circumstances stated
in the affidavit filed in support of the petition, the High Court may be pleased to direct
the respondents to Revaluate answer scripts of the petitioner of the two subjects ie.,
Pathology and Forensic Medicine of the M.B.B.S {1 year which was held in the month of
March 2021 in the interest of justice, pending disposal of the Writ Petition No.12872 of
2021, on the file of the High Court. aa
The petition coming on for hearing, upon perusing the Petition and the affidavit
filed in support thereof and upon hearing the arguments of SRILRAV! CHEEMALAPATI
Advocate for the Petitioner, GP for Medical & Health for Respondent No.1 and of
Sri.G.Vijaya Kumar, learned Standing Counsel for Respondent No.2, the Court made
the following.
ORDER:
The Controller of Examinations and Technicians, who are conversant
with the digital evaluation of the answer scripts relating to the present writ
petition i.e., Pathology and Forensic Medicine of MBBS # year exams held
in March 2021 (along with answer scripts) shall present in Court on
04.08.2021. The petitioner also shall present in Court on 04.08.2021.
