                 WRIT PETITION No.25858 of 2020
ORDER:

The petitioners had obtained a licence from the

3rd respondent to run a bunk at the bus stand area of the

3rd respondent-Temple with effect from 01.12.2019 to 30.11.2020.

Unfortunately, the petitioner was not able to operate the bunk and

recover the licence fee paid by him, on account of COVID-19

pandemic.

2. The petitioners also gave a representation to the

3rd respondent on 25.09.2020 seeking extension of the lease period.

This representation was made in view of the issuance of e-tender

notification, dated 23.09.2020, vide proceedings in

Rc.No.A1/55/2020, for fresh licence to be granted. The

petitioners had also filed W.P.No.18167 of 2020, wherein interim

directions, dated 08.10.2020, were granted directing the

respondents not to finalise the tenders till a decision is taken by the

2nd respondent on the representation made.

3. The petitioners are now before this court for a direction to

the 3rd respondent to permit the petitioners to run their shops

pending consideration of the applications of the petitioners by the

2nd respondent for extension of time/reduction of rentals.

4. In a similar situation in relation to the 3rd respondent-

Temple, this court by order, dated 15.12.2020, in W.P.No.23613

of 2020 had passed certain directions.

5. Following the said judgment, this writ petition is disposed of

with a direction to the 2nd respondent to consider the

representation of the petitioners, dated 25.09.2020, and pass

appropriate orders, in accordance with the governing law and rules

expeditiously, not later than two weeks from the date of receipt of

a copy of this order and communicate the order to the petitioners

from the 3rd respondent. Till such exercise is completed,

the petitioners shall be permitted to conduct their licensed

business. There shall be no order as to costs.

As a sequel, pending miscellaneous applications, if any,

shall stand closed.
