                       WRIT PETITION No.2012 of 2021

ORDER:

This writ petition is filed under Article 226 of the Constitution of

India seeking the following relief:-

"........to issue a writ, order or direction more particularly one in the

nature of WRIT OF MANDAMUS, declaring the action of the respondents

in deferring petitioner's case for promotion to the post of Sub-Registrar

Grade-I in the Approved List of candidates for promotion as Sub-

Registrar Grade-I in Zone-III for the panel year 2020-21 vide

Procdgs.No.REV08-11048/1/2020-IGRS-III, dated 07.01.2021 on the

ground of pendency of surprise check proceedings though the petitioner

is not under currency of any disciplinary or criminal proceedings i.e.,

neither charge memo nor charge sheet is issued till date in 2016, as

being arbitrary, illegal, contrary to the orders issued in G.O.Ms.No.66,

dated 30.01.1991 and judgments rendered in this regard including the

Order passed by this Court in W.P.No.3315 of 2019 dated 23.01.2020

and violative of Articles 14 and 16 of the Constitution of India and further

be pleased to hold that the petitioner is entitled to have his case

considered and be promoted as Sub-Registrar Grade-I without reference

to the pendency of surprise check proceedings C.No.2/SC-ACB-

OGL/2016 on the analogy of Orders passed in similar cases and on par

with his juniors with all consequential benefits in the interest of justice

and to pass such other order or orders."

At the stage of admission, learned counsel for the petitioner

Sri V.Ravichandran and the learned Government Pleader for Services-I

appearing for the respondents fairly conceded that the issue involved in

this petition is squarely covered by the order dated 28.01.2021 passed by

this Court in W.P.No.1287 of 2021.

Since the dispute is covered by the order dated 28.01.2021 passed

by this Court in W.P.No.1287 of 2021, this Writ Petition is disposed of, in

terms of the said order. No costs.

Registry is directed to attach a copy of the order in

W.P.No.1287 of 2021 dated 28.01.2021 to this order.

Consequently, miscellaneous applications, pending if any, shall

stand closed.
