Dake Brahmeswara Rao, vs State Of Andhra Pradesh
2021 Latest Caselaw 441 AP

Citation : 2021 Latest Caselaw 441 AP
Judgement Date : 29 January, 2021

Andhra Pradesh High Court - Amravati
Dake Brahmeswara Rao, vs State Of Andhra Pradesh on 29 January, 2021
Bench: M.Satyanarayana Murthy
THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY

                 WRIT PETITION NO.2192 OF 2021
ORDER:

This writ petition is filed under Article 226 of the Constitution

of India seeking the following relief:-

"....to issue Writ Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent in not considering the petitioners for promotions to the post of Junior Veterinary Officer in Zone-II and the action of the 2nd respondent in not disposing the petitioners' representation, dated 23.10.2020, as illegal improper unjust arbitrary and contrary to Andhra Pradesh State and Subordinate Service Husbandry Subordinate Service Rules 2003 and consequently to direct the respondents not to effect promotions to the post of Junior Veterinary Officer in Zone-II till disposal of petitioners' representation, dated 23.10.2020 by the 2nd respondent and to pass such other order."

2. Though the petitioners made several allegations against the

respondents, during hearing, Sri Manchanapalli Suryanarayana,

learned counsel for the petitioners limited his request to dispose of

the representation made by the petitioners on 23.10.2020, without

touching the merits of the case.

3. Learned Government Pleader for Animal Husbandry appearing

for respondents readily agreed to dispose of the representation dated

23.10.2020 submitted by the petitioners, if any, pending with the

respondent-authorities.

4. In view of the learned Government Pleader for Animal

Husbandry, I need not decide the truth or otherwise of the

allegations made in the petition. This Court is conscious that no

such direction be issued, in view of the judgment of the Apex Court

in "The Government of India v. P.Venkatesh1", wherein the Apex

Court held that such orders may make for a quick or easy disposal of

cases in overburdened adjudicatory institutions. But, they do not

service to the cause of justice. As the learned counsel for the

petitioners himself requested to issue a direction to dispose of the

representation dated 23.10.2020 submitted by the petitioner, I find

no other alternative, except to issue such direction.

5. In the result, the Writ Petition is disposed of, directing the

respondent authorities to dispose of the representation submitted by

the petitioners dated 23.10.2020, in accordance with law, within a

month from today. No costs.

As a sequel miscellaneous application, pending, if any, shall

also stand closed.
