                   WRIT PETITION No.1577 OF 2021

ORDER:

This writ petition under Article 226 of the Constitution of

India is filed questioning the action of 4th respondent in not

disposing the application of petitioners dated 23.12.2019, for

mutation of their names and rectification of entries in the

concerned revenue records, declare the same illegal and arbitrary.

2. Though the petitioners made several allegations against

respondents, during hearing, the learned counsel for the

petitioners requested this Court, to issue direction to

respondents, without touching the merits of the case, to consider

and dispose of the application of the petitioners dated

23.12.2019.

3. The learned Assistant Government Pleader for Revenue also

readily agreed for disposal of the application of petitioners, dated

23.12.2019, if any, pending with the authorities.

4. In view of the submission made by learned Assistant

Government Pleader for Revenue, this Court is not inclined to go

into the truth or otherwise of the allegations made in the petition.

This Court is conscious that no such direction be issued, in view

of the judgment of the Apex Court in The Government of India v.

P.Venkatesh1, wherein the Apex Court opined that such orders,

may make for a quick or easy disposal of cases, but overburden

adjudicatory institutions and they do no service to the cause of

justice. As both the learned counsel submitted that the matter

can be disposed of as mentioned above, this Court find no other

alternative except to issue such direction.

5. In the result, the writ petition is disposed of, directing 4th

respondent to consider and dispose of the application of

petitioners dated 23.12.2019, in accordance with law, for

mutation of their names and rectification of entries in concerned

revenue records, strictly adhering to G.O.Ms.No.209 dated

14.06.2017, within two (2) weeks from the date of receipt of copy

of this order. There shall be no costs.

6. Consequently, miscellaneous petitions pending, if any, shall

stand closed.
