Petition under Section 397(1) of Cr.P.C praying that in the circumstances stated
in the memorandum grounds of criminal petition, the High Court may be pleased to
suspend the operation of the sentence and conviction rendered against the petitioner
vide judgment in CriA.No.395/2019, dt.03.02.2021 on the file of the VIII Additional
District & Sessions Judge-cum-Special Court For the trial of offences Against Women,
Nellore by confirming the conviction and sentence rendered against the petitioner by the
V Additional Judicial Magistrate of I Class, Nellore vide judgment in CC.No.1117/2017
dt.27-11-2019, pending disposal of CRLRC No. 89 of 2021, on the file of the High
Court. ~~
The court, while directing issue of notice to the Respondents herein to show
cause as to why this application should not be complied with, made the following
order.(The receipt of this order will be deemed to be the receipt of notice in the case). --
ORDER:
"Heard.
Learned counsel for the petitioner submits that the petitioner has already
deposited 20% of the compensation amount before the trial Court and he filed the
copy of receipt to that effect.
The sentence of imprisonment against the petitione accused passed in
judgment dated 03.02.2021 in Criminal Appeal No.395 of 2019 on the file of VIII
Additional District & Sessions Judge-cum-Special Court for the trial of Offences
against Women, Nellore confirming the conviction passed in judgment dated
27.11.2019 in C.C.No.1117 of 2017 on the file of V Additional Judicial Magistrate of
First Class, Nellore alone is suspended pending the criminal revision case on
condition of petitioner surrenderring before the V Additional Judicial Magistrate--

petitioner shall be released on bail on the same day on his executing a bond fora
sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties each for a
