WRIT PETITION NO.2455 OF 2021
ORDER:
This writ petition is filed under Article 226 of the Constitution
of India seeking the following relief:-
"....to issue Writ Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the impugned action of the respondents in not considering petitioner representations dated 11.10.2013, 31.01.2018 and 30.11.2018 made the post of V.R.O. for appointment in terms of G.O.Ms.No.39, dated 11.01.2008 while considering similarly placed ex-nomine village administrative V.A.O. as illegal, arbitrary, unreasonable and violation of the principles of natural justice and violation of Articles 14 and 21 of the Constitution of India and consequently hold that the petitioner is entitled for V.R.O. or appointment to any suitable post in terms of G.O.Ms.No.39, dated 11.01.2008 as was done in similarly placed persons vide proceedings No.R.Dis No.A1/2908/2011 dated 15.09.2011 with all consequential benefits by following the orders passed in W.P.No.30960 of 2015 dated 06.10.2015 and pass such other order."
2. Though the petitioner made several allegations against the
respondents, during hearing, Sri K.Srinivasa Prasad, learned counsel
for the petitioner limited his request to dispose of the representations
made by the petitioner dated 11.10.2013, 31.01.2018 and
30.11.2018, without touching the merits of the case.
3. Learned Government Pleader for Revenue appearing for
respondents readily agreed to dispose of the representations dated
11.10.2013, 31.01.2018 and 30.11.2018 submitted by the petitioner,
if any, pending with the respondent-authorities.
4. In view of the learned Government Pleader for Revenue,
I need not decide the truth or otherwise of the allegations made in
the petition. This Court is conscious that no such direction be
issued, in view of the judgment of the Apex Court in "The
Government of India v. P.Venkatesh1", wherein the Apex Court
held that such orders may make for a quick or easy disposal of cases
in overburdened adjudicatory institutions. But, they do not serve to
the cause of justice. As the learned counsel for the petitioner himself
requested to issue a direction to dispose of the representations dated
11.10.2013, 31.01.2018 and 30.11.2018 submitted by the petitioner,
I find no other alternative, except to issue such direction.
5. In the result, the Writ Petition is disposed of, directing the
respondent authorities to dispose of the representations submitted
by the petitioner dated 11.10.2013, 31.01.2018 and 30.11.2018, in
accordance with law, within four (04) weeks from today. No costs.
As a sequel miscellaneous application, pending, if any, shall
also stand closed.
