HCJ & CPK, J W.A.No.76 of 2021
directed to maintain status quo regarding the subject land till the next date
of hearing.
2. It is submitted that respondent No.8 herein did not appear before
the learned single Judge.
3. Mr. B. Adinarayana Rao, learned Senior Counsel assisted by Mr. P.
Kamalakar, learned counsel for the appellant, submits that the appellant is
making very limited prayer in this appeal, which is to the effect that in the
subject land, the appellant had cultivated Green gram crop and the same is
ready for harvesting, and if the harvesting is not done immediately, the
entire produce will go waste and therefore, the appellant may be permitted
to harvest the same in the presence of the Station House Officer, Nagari
Police Station, Chittoor District and thereafter, to keep the harvest in a part
of the land taking due precaution for not letting it go waste.
4. Mr. Jada Sravan Kumar, learned Counsel for the respondent/writ
petitioner submits that to the limited prayer made by Mr. B. Adinarayana
Rao, learned Senior Counsel, he will have no objection. The Counsel
appearing for the other respondents endorsed the above submission.
5. In view of the above submission, a consent order is passed
permitting the appellant to harvest the standing Green gram crop in the
presence of the Station House Officer, Nagari Police Station, and to keep
the same in the part of the land itself.
6. It is made clear that save and except the above, we have not
interfered with the direction to maintain status quo as issued by learned
single Judge.
