WRIT PETITION No.5447 of 2016
ORDER:
This Writ Petition is filed under Article 226 of the
Constitution of India, by the petitioner to issue a Writ, order or
direction more particularly one in nature of Writ of Mandamus,
declaring the inaction on the part of the respondents in
regularizing the services of the petitioner as Pump Operator in the
2nd respondent-Corporation, as illegal and arbitrary and
consequential direction to respondents to regularize the services of
the petitioner as Pump Operator.
2. Heard learned counsel on both sides.
3. During the course of hearing, learned Standing Counsel
appearing on behalf of the 2nd respondent-Corporation stated that
the petitioner can make a fresh representation to the 2nd
respondent-Corporation seeking to regularize his services, which
can be disposed of by the latter, in accordance with law.
4. Recording the said submission, this Court is inclined to
dispose of the writ petition with the following directions :
i) The petitioner is directed to file a fresh representation
before the 2nd respondent-Corporation, within a period
of two (02) weeks from the date of receipt of a copy of
the order.
ii) On such representation being made, the 2nd
respondent is directed to consider the same on merits
and pass appropriate orders in accordance with law, by
following the principles laid down in the Judgment of
the Apex Court in Umadevi's1 case, within a period of
four (4) weeks thereafter, positively. No costs.
Pending miscellaneous applications, if any pending, shall
stand closed. No costs.
