                 WRIT PETITION No.7866 OF 2021

ORDER:

When the matter is taken up, it is brought to the notice of

this Court by the learned counsel for the petitioner that the issue in

the present Writ Petition is squarely covered by the orders of this

Court passed in Writ Petition No.18977 of 2020 dated 02.09.2021.

A copy of the said order is placed on record by the learned counsel

for the petitioner.

Following the above said order and for the reasons recorded

therein, this Writ Petition is disposed of in terms the said order,

directing respondent No.1 herein to consider the application of the

petitioner dated 16.09.2020 and pass appropriate orders in the

light of the guidelines laid down by the Hon'ble Supreme Court in

Jigya Yadav v. C.B.S.E. & others in Civil Appeal No.3905 of 2011

and batch. It is open for the petitioner herein to place before the

respondents, additional material, if any, so also the copy of the

judgment referred to supra for consideration of the same by the

respondents within a period of six weeks from the date of receipt of

a copy of this order. It is also made clear that the petitioner herein

is at liberty to place on record a copy of the application submitted

by him dated 16.09.2020 before the respondents for necessary

action. Office to enclose a copy of the order dated 02.09.2021

passed in W.P. No.18977 of 2020 passed by this Court.

As a sequel, interlocutory applications pending, if any, in this

Writ Petition shall stand closed. There shall be no order as to costs

of the Writ Petition.
