 HON'BLE SUBHASH VIDYARTHI, J.

1. Heard Ms. Nandita Bharti, the learned counsel for the petitioner and perused the records.

2. By means of the instant petition filed under Article 227 of the Constitution of India the petitioner has sought issuance of a direction to the learned Civil Judge, Senior Division, Malihabad, Lucknow the petitioner's application for temporary injunction (paper no.C-6) pending in Regular Suit No.2156 of 2025: Shri Ram Maurya Vs. Aaysha Khatoon and others.

3. The petitioner has filed the aforesaid suit on 30.09.2025 and finding no good ground to pass ex-parte order of temporary injunction the learned trial court issued notices on the application for temporary injunction to the defendants. On 13.11.2025 the learned trial court passed an order holding the service of the notice on the defendants to be sufficient. On 16.12.2025 the learned trial court granted last opportunity to the defendants for filing written statement/objections against the temporary injunction application and fixed 14.02.2026 as next date. On 08.01.2026 the petitioner filed an application for early hearing but no order was passed on the application and it was merely kept in file. On 19.01.2026 the petitioner filed yet another application for early disposal of application for temporary injunction but no order has been passed on the said application.

4. Further, this Court has issued a Circular Letter dated 16.08.2017 (C.L. No.24/Admin. 'G-II' Dated: Allahabad 16.08.2017) regarding time bound disposal of the interim injunction application which provides that "it is necessary that the temporary injunction application shall be disposed of within six months, failing which they shall have to record reasons in the order sheet".

5. Keeping in view the aforesaid facts and circumstances of the case, the petition is disposed off by issuing a direction to the learned Civil Judge, Senior Division, Malihabad, Lucknow to dispose of the application for temporary injunction pending in Regular Suit No.2156 of 2025: Shri Ram Maurya Vs. Aaysha Khatoon and others expeditiously keeping in view its order dated 16.12.2025 as also the Circular Dated 16.08.2017 issued by this Court.
