1. Heard learned Counsel for the applicant and learned A.G.A.
2. The contention of the Counsel for the applicant is that no material was filed along with the charge-sheet to allege any action at the instance of the applicant which can lead to the conclusion that the applicant is guilty of the offencs, in which, the applicant has been charge-sheet and this aspect has not been considered in the summoning order.
3. Considering the aforesaid fact, the present application is disposed off permitting the applicant to move an application through Counsel for discharge.
4. In case, the applicant moves such application for discharge, the same shall be considered in accordance with law.
5. It is further provided that although the anticipatory bail of the applicant was dismissed, the apprehension of arrest after the summoning order arose, as such, it is open to the applicant to move a fresh anticipatory bail application in accordance with law.
