1. Heard learned counsel for the appellant(s) and learned AGA for the State Sri Badul Hasan.
2. The instant Criminal Appeal under Section 374 (2) Cr.P.C. has been filed by the appellants namely Jitendra S/o Munnu and Chandan S/o Alok Soni challenging the judgment and order 21.12.2010 passed by learned Additional Sessions Judge, F.T.C. No. 30, Barabanki in Session Trial No. 38 of 2009 thereby sentencing the appellants under Section 489 IPC for a period of six months and fine of Rs. 5000/- each.

The story of prosecution, in nutshell, is to the effect that on 23.06.2008 accused-appellants namely Jitendra S/o Munnu and Chandan S/o Alok Soni were apprehended by the police party consisting of S.I. R.C. Pandey, Constable/Arvind Singh, Constable/Manoj Kumar, S.I./Shyam Babu Shukla, Constble/Rampratap, at about 06:30 PM.
4. From the possession of accused/Jitendra S/o Munnu eight fake currency notes of Rs. 100/- having No. 3 A N 686677 were recovered. Six fake currency notes of Rs. 100-/ having No. 6 A N 686677 were recovered from the possession of the accused /Parasnath Verma. Six fake notes of Rs. 100/- having No. 6 A N 686677 were recovered from the possession of the accused/Chandan.
5. After the aforesaid, recovery memo (Ext. Ka-1) was prepared. Thereafter, upon completion of investigation charge sheet(s) (Ext. Ka-1 and 2) were submitted before the Court concerned. It is to be noted that the Site Plan (Ext. Ka-3), Chik FIR (Ext. Ka-7) and Expert report (Ext. Ka-8) were also submitted before the Court concerned.
6. After submission of charge sheet, learned Magistrate took cognizance and thereafter the said case was committed to the Court of Session where it was registered as Session Trial No. 38 of 2009 and charges were framed against the appellants, which they denied and claimed trial.
7. In order to substantiate its case, prosecution examined as many as nine witnesses namely S.I. Shyambabu Shukla/PW-1, S.I. Rameshchandra Pandey/PW-2, Jagdish Prasad Singh/PW-3, S.I. Ahmad Zalal Zaidi/PW-4 and Jagannath Swami/PW-5. These prosecution of witnesses established the case of the prosecution and proved the documentary evidence viz. charge sheet(s) (Ext. Ka-1 and 2), Site Plan (Ext. Ka-3), Chik FIR (Ext. Ka-7) and Expert report (Ext. Ka-8).
8. That after closing of the evidence, statements of accused/ appellants were recorded in terms of Section 313 Cr.P.C. by the trial court, after explaining the entire evidence and other circumstances, in which the appellants denied the prosecution story and the entire prosecution story was said to be wrong and concocted.
9. After recording of the statement(s) under Section 313 CrPC Defence also produced its witnesses namely Om Prakash Verma/DW-1, Ajay Kumar/DW-2, Hansraj Verma/D.W.-3, Mohd. Sabbir/D.W.-4 and Sunil Soni/D.W.-5.
10. Thereafter, the learned trial court after hearing learned counsel for both the parties and appreciating the entire evidence, oral as well as documentary, found the accused/appellants guilty and convicted them as above. Relevant portion of the order dated 21.12.2010 is extracted here-in-under:-

In the aforesaid background of the case, learned counsel for the appellant submitted that the trial Court committed error of fact and law both in not considering the facts of the case in the light of ht evidence produced before it and as such interference of this Court is required in the matter and appellants are liable to be acquitted.
12. Sri Arun Kumar, learned AGA appearing for the State submitted that judgment of the trial court is justified as prosecution has established its case as indicated in the FIR.
13. Upon due consideration of submissions of learned counsel for the parties and the evidence available on record, this Court finds that the trial Court has not committed any irregularity or illegality in passing the judgment under appeal dated 21.12.2010. It is for the following reason(s)-
(i) The recovery of fake currency from the possession of the accused-appellant and documentary evidence, indicated above, were proved before the trial Court by the prosecution witnesses namely S.I. Shyambabu Shukla, S.I. Ramesh Chandra Pandey, Incharge Police Station-Jagdish Prasad Singh, S.I. Ahmad Jalal Zaidi and Constable Jagannath Swami.
(ii) The fact that the currency recovered from the possession of the accused-appellants was fake was established/proved by providing the expert report (Ext. Ka-8).
14. For the reason(s) aforesaid, the instant appeal is dismissed.
15. Copy of this judgment and trial Court record be sent back to the Court concerned.
