1.Heard Sri Nirbhay Kumar Bharti, learned counsel for the applicant.

2.By means of this application, applicant has prayed to quash/set aside the ex.parte judgment & order dated 24-11-2018 passed by the learned Principal Judge, Family Court, Ballia in Case No.422/2017, Kiran Devi & another Vs. Ranjan Kumar, U/s 125 Cr.P.C. as well as recovery warrant dated 21-12-2020 issued by the learned Principal Additional Judge Family Court, Ballia in Case No.135/2019, Kiran Devi & another Vs. Ranjan Kumar, U/s 125(3) Cr.P.C. P.S. Rasra, District Ballia.

3. Learned counsel for the applicant after arguing for sometime fairly submitted that an application has been filed under Section 126 (2) Cr.P.C. along with delay condonation application though at a belated stage however, the same may be considered in accordance with law.

4. In aforesaid circumstances without going into the merits of the case, this application is disposed of with an observation that learned Family Court will decide the application so filed under Section 126 (2) Cr.P.C. finally along with the delay condonation application expeditiously.
