1. The petitioner has preferred the present petition inter alia with the prayer to quash the order dated 21.06.2022 passed by the Chairman of the corporation. Copy of the same is annexed as Annexure No. (5) to the present petition.

2. Preliminary objection with regard to maintainability of the writ petition has been raised by the learned counsel for respondent Nos. 2 & 3 that against the order statutory alternative remedy is available to the petitioner to file an appeal and revision, as provided in U.P. Power Corporation Limited Employees (Discipline and Appeal) Regulations, 2020.

3. Learned counsel for the respondents has also placed reliance upon a judgment passed by the Division Bench of this Court in Special Appeal No.566 of 2022 (Smt. Shaheen Badar vs. U.P. Power Corporation Limited and others). The aforesaid special appeal was dismissed vide order dated 02.09.2022.

4. Heard learned counsel for the petitioner, learned Standing counsel for the State-respondent, Sri Abhishek Srivastava, learned counsel for respondent nos.2 & 3 and perused the record.

5. Considering the facts and circumstances of the case and without interfering with the order impugned, the present petition is disposed of permitting the petitioner to approach the appellate authority as provided in U.P. Power Corporation Limited Employees (Discipline and Appeal) Regulations, 2020.

6. In case any such appeal is filed by the petitioner within a period of three weeks from today, the appellate authority is directed to consider the same expeditiously.
