HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH

?Neutral Citation No. - 2024:AHC-LKO:36261-DB

Court No. - 2

Case :- WRIT - C No. - 4213 of 2024

Petitioner :- Mustak Ahamad

Respondent :- State Of U.P. Thru. Addl. Chief Secy. Revenue Civil Secrt. Lko. And Others

Counsel for Petitioner :- Shiv Sharan Singh

Counsel for Respondent :- C.S.C.

Hon'ble Rajan Roy,J.

Hon'ble Om Prakash Shukla,J.

1. Heard Shri Yogendra Yadav, Advocate appearing on behalf of Shri Shiv Sharan Singh, learned counsel for the petitioner and learned Standing Counsel for State-respondents.

2. This writ petition has been filed with the following main prayer :-

"(i) Issue a writ, order or direction in the nature of Mandamus thereby commanding the opposite parties not to interfere in the peaceful possession over the abadi land of the petitioner and also compliance of the impugned order dated 19-03-2024 passed by the IVth Additional District & Sessions Judge, Raibareli in favour of the petitioner contained as Annexure No. 1 to this writ petition."

3. We have perused the order dated 19.03.2024. By this order, Regular Appeal No.33 of 2018, filed by private opposite party, challenging the judgment and order dated 07.04.2018 passed by the trial Court, has been dismissed. The trial Court had also dismissed the Suit of the private opposite party.

4. We fail to understand as to how relief as has been prayed in this petition could have been possibly drafted by an Advocate and how such a petition could have been filed. We say no more but leave it for the Advocate to introspect about it in the hope that he will not repeat the same.

5. The petition is absolutely misconceived and is, accordingly, dismissed. If there is a cause the petitioner can pursue other remedies, seeking injunction, etc.

(Om Prakash Shukla, J.) (Rajan Roy, J.)
