1. Sri Amit Kumar Dwivedi, Advocate has filed his Power today on behalf of respondent no.2, which is taken on record.

2. Heard learned Counsel for the petitioner, learned Standing Counsel and Sri Amit Kumar Dwivedi, learned Counsel representing respondent no.2.

3. A similar matter has already been disposed of vide judgment dated 19.11.2015 in W.P. No. 10743(MB) of 2015, M/s Shatkashi Construction Company v. State of U.P. and others, which is not disputed by the learned counsel for the Nagar Nigam.

4. Accordingly, this matter is also covered by the decision in the case of Tajveer Singh v. State of U.P. and others [1997 ALJ 285]. The petitioner shall also be entitled to the same benefits.

5. The writ petition is disposed of with the said directions.
