Criminal Misc.Correction Application No.1 of 2022

1. Heard learned counsel for the applicants, learned AGA and perused the correction application.

2. This is a correction application for adding section "& 3(ii)Va, SC/ST Act" after 7/8 POCSO Act, 2012 in sixth line of second paragraph of the order dated 12.10.2023 passed by this Court.

3. The facts of the case was not transcribed in the order passed on 12.10.2023 that applicants have not pressed the application on behalf of applicant nos. 1 & 2 and applicant nos.3, 4 & 5 were summoned in offence under sections 147, 323, 504, 506 I.P.C. and section "3(ii)Va, SC/ST Act".

4. Learned counsel for the applicants nos.3 to 5 were summoned in offence under sections 147, 323, 504, 506 I.P.C. & Section 3(ii)Va, SC/ST Act and enlarged on bail in view of Apex Court judgment in the case of Satender Kumar Antil vs. Central Bureau of Investigation and another, reported in 2021 SC Online SC 922.

5. The correction application stands allowed.

6. In sixth line of second paragraph of the order dated 12.10.2023, section "3(ii)Va, SC/ST Act" may also be added after 7/8 POCSO Act, 2012.

7. This order shall be treated as part of the order dated 12.10.2023.

8. A certified copy of this order shall be issued along with copy of order dated 12.10.2023.
