On the matter being taken up, A.G.A. for the State submits that against the order impugned, which is an ex parte order, the revisionist has an efficacious statutory alternative remedy by way of an application under Section 126 (2) Cr.P.C. before same Court, therefore, the present criminal revision along with delay condonation application is liable to be dismissed with liberty to him to avail his remedy as may be permissible under law before appropriate forum/court of law.

The instant revision is accordingly dismissed along with delay condonation application on the ground of statutory alternative remedy as aforesaid.

Certified copy of the impugned judgment and order shall be returned to the learned counsel for the revisionist after retaining a photo copy of the same to be kept on record.
