A preliminary objection has been raised by the learned Standing Counsel, Sri Shyam Sunder that the order impugned is actually a judgment and order passed in Original Suit No. 1009 of 2016 that has been passed by the Civil Judge ( J.D.), Bansgaon, Gorakhpur in the case of Smt. Bahona Devi and others Vs. State of U.P. and another. It is further stated that pursuant to the aforesaid judgment and order, a decree has also been prepared on 9.2.2023.

At this stage, without making any argument/submission, learned counsel for the petitioner, Sri Kamlesh Kumar Nishad states that he may be permitted to withdraw this petition.

This petition is, accordingly, dismissed as withdrawn. However, since no argument has been advanced by the learned counsel for the petitioner in this regard, no cost is being imposed.
