1. Heard Sri Virendra Kumar, learned counsel for the revisionist and Sri O.P. Mishra, learned A.G.A. for the State.
2. By means of this criminal revision, a judgment and order dated 04.01.2023 passed by Additional Principal Judge, Family Court, Saharanpur in Case No. 531 of 2018, under Section 125 Cr.P.C., Police Station Sadar Bazar, District Saharanpur has been challenged.
3. The revisionist at the very outset requested this Court that this criminal revision may be dismissed as he is no more interested to press it as the parties arrived at compromise in a proceeding which is being considered under Section Section 13-B of the Hindu Marriage Act, 1955.
4. Learned A.G.A. submitted that once criminal revision has been filed, legally it cannot be either withdrawn or decided on the basis of non prosecution. The Court should decide it on merit.
5. I went through papers on record including the impugned order. I do not find any manifest error or illegality, procedural or otherwise, so as to justify interference in criminal revision. In my view, the order has been passed after appreciation of evidence giving cogent reasons. Hence the criminal revision is dismissed.
6. Certify this judgment to the lower court concerned.
7. Lower court record be sent back to the court concerned.
