This appeal has been preferred by the State alongwith an application for grant of leave to challenge the judgment of acquittal dated 08.03.2022, passed by the court below in Sessions Trial No. 121 of 2017(State Vs. Akhilesh Nishad), arising out of Case Crime No. 890 of 2016, under Sections 376, 506 IPC, Police Station Bhognipur, District Kanpur Dehat. The appeal itself has been preferred alongwith an application for condonation of delay.

In view of the fact that five member committee constituted at the level of the Government Advocate has opined that this is not a fit case to challenge the judgment of acquittal, learned counsel comes up with a prayer to not press the appeal.

Delay condonation application as well as the appeal both are, accordingly, dismissed as not pressed.
