Allahabad High Court
Raj Narayan Mishra vs Comm.Devi Patan Mandal Gonda And ... on 12 May, 2023
Bench: Rajnish Kumar

HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH

?Neutral Citation No. - 2023:AHC-LKO:32970

Court No. - 6

Case :- WRIT - C No. - 1003385 of 2010

Petitioner :- Raj Narayan Mishra

Respondent :- Comm.Devi Patan Mandal Gonda And Another

Counsel for Petitioner :- Nitin Srivastava

Counsel for Respondent :- C.S.C.,Janardan Singh

Hon'ble Rajnish Kumar,J.

None is present on behalf of the petitioner to press this petition nor there is any request to pass over or adjourn the case.

Perusal of the order sheet indicates that the case is being got repeatedly adjourned by the learned counsel for the petitioner on one or other ground. It appears that the petitioner is not interested in pursuing the case. Even otherwise now this petition is not maintainable under Article 226 of the Constitution of India in view of the judgment of Hon'ble Supreme Court in the case of Radhe Shayam and Another Vs. Chhabi Nath and Others; (2015) 5 SCC 423.

The writ petition is, accordingly, dismissed for want of prosecution.

Interim order, if any, stands vacated.

...................................................................(Rajnish Kumar, J.)

Order Date :- 12.5.2023
