1. Heard Sri Ashok Kumar Singh, Sri Jyoti Kumar Singh, Sri Firoz Haider, Sri Narendra Singh Chahar learned counsel for the petitioner, Sri Kaushlesh Pratap Singh, Sri Tarun Agrawal, Sri Atul Tej Kulshrestha, Sri Ram Bahadur Singh, Sri Ten Singh and the learned Standing Counsel for the respondents.
2. Present and the connected matters have been filed to assail the Notification No. 3811/9-1-2022-04 Nirwachan/2022 dated 05.12.2022 providing for reservation for the purpose of urban body elections.
3. Suffice to note, earlier the matter was considered by the Court sitting at Lucknow in Public Interest Litigation (PIL) No. 878 of 2022 (Vaibhav Pandey Vs. State of U.P. and Another) and the connected matters. Those petitions were allowed by judgment and order dated 27.12.2022. It became subject matter of challenge before the Supreme Court in Civil Appeal No. 2047 of 2023 (State of Uttar Pradesh Vs. Vaibhav Pandey and Another). By order dated 27.3.2023 passed in that and the connected appeals, the Supreme Court disposed of the appeals with direction issued to the State Government and the State Election Commission.
4. Without referring to those facts in detail, it is undisputed between the parties, pursuant to the above order of the Supreme Court, fresh exercise was undertaken to provide for reservation. Draft Notification and final Notification have been issued and the polling is to take place on 4th and 11th of this month.
5. In view of the above, present batch of petitions have been rendered infructuous.
6. Accordingly, these petitions are disposed of as infructuous.
