This appeal has been preferred by accused-appellant Dalchand challenging his conviction and sentence vide judgment and order dated 02.02.2009 passed in Sessions Trial No. 508 of 2005 (State vs. Dalchand and others) arising out of Case Crime No. 678 of 2004, under Section 364A IPC, P.S. Behjoi, District Moradabad.

A report has been submitted by the Chief Judicial Magistrate, Moradabad as per which the accused Dalchand was transferred to Central Jail, Bareilly where he died on 10.07.2015, documents in support of such communication have also been annexed.

Since sole appellant has died, as such, this appeal stands abated and accordingly consigned to records.
