Heard Sri Chandra Bhan Kushwaha, learned counsel for the applicant and Sri Raghav Kumar Mishra, learned Standing Counsel, who appears for the opposite party.
The present petition has been filed alleging willful disobedience and non-compliance of the judgment and order dated 06.09.2022 in Criminal Misc. Writ Petition No.12278 of 2022, Jayant Maheshwari Vs. State of U.P. and others, whereby a direction was issued to the police authorities to conclude the investigation relating to Case Crime no. 282 of 2021, under Section 364 IPC, P.S. Wazirganj, Budaun fairly, impartially and expeditiously.
On 22.12.2022 and 08.02.2023, the learned Standing Counsel was required to obtain instructions and to apprise the Court about the stage of investigation in question.
Today, when the matter was taken up, learned Standing Counsel has produced before this Court the instructions dated 18.03.2023 of the S.S.P., Budaun, wherein it has been mentioned that the final report has been submitted against the accused on 16.03.2023.
Learned counsel for the applicant/ petitioner on the other hand submitted that since a final report has been submitted and that the order has been complied with and according to him, the applicant herein shall take appropriate remedy as envisaged under the Code of Criminal Procedure, 1974 for redressal of his grievances.
Accordingly, present contempt application is consigned to record.
