The present petition has been filed with the following prayers:-

"(i) Issue a writ, order or direction in the nature of mandamus directing the respondents to grant the notional III financial upgradation grade pay of Rs. 7600/- with effect from the completion of the 26th year services of the petitioners.

(ii) Issue a direction, directing the respondents to fix the pension of the petitioner after granting the notional IIIrd financial upgradation pay grade Rs. 7600/-."

Learned counsel for the petitioners submits that the financial upgradation has not been provided to the petitioners despite the representation. He has relied upon the Government Orders dated 5.11.2014 and 3.3.2015 to support the contention that the financial upgradation is required to be granted to the petitioners.

Learned Standing Counsel submits that the claim of the petitioners will be decided in accordance with law in a time bound manner.

Considering the facts and circumstances of the case, the present petition is disposed off giving liberty to the petitioners to file a fresh representation before the respondent no.3, who shall consider and decided the same in accordance with law laid down by this Court, with all expedition, preferably within a period of three months from the date of production of a copy of this order before the respondent no. 3. The petitioners would be at liberty to place the Government Order and the judgment passed by this Court in the fresh representation. It is also provided that the petitioners would be entitled to raise all the grounds including the fact that the junior to the petitioners have been given the benefit.
