Heard learned counsel for the petitioner and the learned standing counsel for the State-respondents.

The limited issue involved in the instant petition is regarding grant of benefit of the decision of the Apex Court in the case of Prem Singh v. State of U.P. and others, (2019) 10 SCC 516 to the petitioner.

The record reveals that the issue had been raised by the petitioner by filing a petition before the High Court which came to be allowed against which a special appeal preferred by the State was dismissed and consequently the matter was escalated before the Apex Court and the contention of the petitioner came to be approved by the Apex Court by means of the order dated 31.01.2020.

It is urged that despite the same, the petitioner has a claim for which no decision has yet been taken.

Considering the aforesaid, learned standing counsel is directed to seek clear instructions including the time within which the benefit which has been accorded by the Apex Court in its judgment and order dated 31.01.2020 passed in Civil Appeal No.872 of 2020 shall be paid.

List this matter again on 28.03.2023, as fresh.
