Arms licence of the petitioner was cancelled on the ground that he was involved in a case arising out of Section 26 of Indian Forest Act. The appeal thereof was also rejected.
Learned counsel for petitioner submits that before Permanent Lok Adalat, petitioner has admitted his guilt and deposited the fine imposed on him on 11.9.2022, therefore, basis for cancellation of arms license is now extinguished, therefore, his arms license be restored back.
Learned Standing Counsel submits that order passed by Permanent Lok Adalat is a subsequent event which was not brought on record before appellate authority, therefore impugned orders cannot be held illegal.
Considering the above submissions and taking note of order passed by Permanent Lok Adalat which was not brought on record before appellate authority, therefore, there is no illegality in the impugned orders. However, petitioner is at liberty to file a fresh application for arms license disclosing above referred facts and appropriate authority under the Arms Act and Arms Rules will consider the application filed by petitioner in accordance with law taking note of the time limit prescribed under the Arms Act and the Rules framed thereunder and considering the judgment passed by this Court in Indrajeet Singh Vs. State of U.P. & Ors, 2021 (10) ADJ 471.
With the aforesaid direction, this writ petition is disposed of.
