Ms. Arti Agarwal, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Jangali against the judgment and order dated 28.03.1995 passed by HJS, Special Judge (DAA), Budaun in Special Session Trial No. 47 of 1983, under Section 395/397 IPC, Police Station Sahaswan, District Budaun.

As per office report dated 17.02.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 23.11.2021 informed that the appellant - Jangali has died one years ago. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
