Present appeal has been filed by Oriental Insurance Co. Ltd. challenging the judgment and award dated 11.2.1998 passed by Motor Accident Claims Tribunal/IXth Additional District Judge, Meerut in Motor Accident Claim Case No. 623 of 1994

The Insurance Company wants to withdraw this appeal because of the subsequent developments in the law which has been laid down by the Apex court and this Court in several decisions.

Officers of the Insurance Company along with counsel are present before this Court.

Claimant-respondents have also preferred cross objection. However, none has appeared for them.

The cross objection preferred by the claimants is dismissed and the appeal of the Insurance Company is permitted to be withdrawn. Interim relief, if any, stands vacated forthwith. Record and proceedings, if here, be sent back to the Tribunal forthwith who shall disburse the amount kept in fixed deposit to the claimants forthwith, if not disbursed earlier.

Sri A.D. Saunders, learned Advocate has appeared for one of the respondents and he has no objection to the appeal being withdrawn by the Insurance Company.
