Heard learned counsel for the petitioner.
The petitioner by means of the present writ petition has prayed for expeditious disposal of Execution Case no.01 of 2021 (Mohd. Safiq Vs. Dev Raj and others) which has been filed for execution of judgment and decree dated 11.08.2017 passed in Original Suit No.400 of 2004. In para 11 of the writ petition, petitioner has stated that the respondents have not filed any appeal against the judgment dated 02.08.2017.
In such view of the fact, this petition is disposed of with a direction to the Civil Judge (Senior Division), Kaushambi to decide Execution Case no.01 of 2021 (Mohd. Safiq Vs. Dev Raj and others) pending before him expeditiously, preferably within a period of nine months from the date of production of a certified copy of this order without granting any unnecessary adjournment to either of the parties, if there is no other legal impediment in deciding the aforesaid case.
In case, if any adjournment is inevitable, the authority concerned may grant the same by imposing heavy cost which may not be less than Rs.1,000/-.
