Present petition has been filed with the following prayers:

"i. issue a writ, order or direction thereby in the nature of Mandamus thereby directing the opposite party No.2 to sanction maternity leave w.e.f. 16th December 2022 to 6 months in the interest of justice.

ii. issue a writ, order or direction thereby in the nature of Mandamus thereby directing the opposite party No.2 to take appropriate decision on the representation dated 22.11.2022 pending before him forthwith or as per direction of this Hon'ble Court (Annexure No. 2).

....."

Contention of learned counsel for the petitioner is that the petitioner is entitled to benefits as claimed by him and places reliance on the judgment of this Court in the case of Dr. Reshma Chaudhary v. State of U.P. & Ors.; Writ - A No.2317 of 2022 decided on 29.04.2022.

Considering the fact that the issue is to be decided by respondent no.2, the present petition is disposed off permitting the petitioner to file a fresh representation before respondent no.2 who shall consider and decide the same in accordance with law with all expedition, preferably within two months.

While taking the decision, the respondent shall consider the judgment in the case of Dr. Reshma Chaudhary (supra).
