The matter is listed before the National Lok Adalat.

Shri Akhilesh Sharan Srivastava, learned counsel for the insurance company is present.

Presently, the Insurance Company feels that the matter is covered by the judgment of the Apex Court and, therefore, it does not wish to pursue this appeal. It has filed an application to withdraw this appeal through Shri Akhilesh Saran Srivastava, Advocate, which is marked as 'X' and is retained on record.

The appeal is deemed settled as withdrawn.

Requisite Court fees as per Legal Service Authorities Act, 1987 would be refunded to the appellant(s) as the matter has been settled in the Lok Adalat.

This will bring to an end lis between the parties. Let this order be communicated to the Tribunal along with its records.

If the award under challenge has yet not been satisfied, the same shall be satisfied within one month from today.

Any amount deposited including pre-deposit made in this appeal shall be remitted to the Tribunal towards satisfaction of the award or to be returned to the appellant(s), if the award has already been satisfied.

Interim order, if any, shall stand vacated.

In the event of failure on part of the insurer to pay the entire amount (if any) within the stipulated time, the insurer further to pay interest @ 6% for the period beginning at the end of one month (from today), upto the date of actual payment.
