This application has been filed alleging non compliance of the order dated 10.02.2021 passed in Writ Petition Service Single No.3927 of 2021.

By means of the aforesaid order, liberty was granted to the applicant to move a representation which was directed to be considered and disposed of in the light of the judgment passed in the case of Amrendra Narain Srivastava versus State of U.P. and others decided on 01.03.2012 in Writ A No.61974 of 2011.

The respondents have passed the order dated 01.04.2021 on the representation of the applicant moved pursuant to the aforesaid order, a copy of which has been placed on record alongwith the affidavit of compliance. Perusal of the same indicates that in view of the directions issued by this Court, the representation of the applicant has been considered and the same has been rejected in the light of the notification dated 31.10.2020.

Learned counsel for the applicant submits that an identical order passed by the respondents has been quashed by this Court by means of the order dated 06.08.2021 passed in Writ A No.9030 of 2021. If it is so, the applicant could have challenged the order passed by the respondents in appropriate forum. Since substantial compliance of the order passed by the writ court has been made therefore this application has lost its efficacy.

Dismissed accordingly.
