It is argued by the learned counsel for the petitioner that the case of the petitioner is squarely covered by the law laid down by this Court in series of cases being Wrti-A No. 14575 of 2021 (Shikha Sharma Vs. State of U.P. and 3 others) decided on 21.06.2022. It is further argued that being into consideration to the aforesaid judgment a letter has already been written by the Special Secretary, State Government to the Director, Secondary Education, U.P. Prayagraj, dated December 20, 2022 to comply with the aforesaid order and make the payment of gratuity to the similar situated teachers.

In this view of the matter, it is argued that the petitioner is also entitled for the payment of gratuity.

On the other hand, it is argued by the learned Standing Counsel that in case petitioner will approach the respondent no. 3, namely, Regional Deputy Director, Secondary Education, Aligarh Region, Aligarh, in this regard, he will pass necessary orders in the matter expeditiously.

Heard learned counsel for the parties present and perused the record.

In the facts and circumstance of the case and without entering into the merits of the case the present writ petition is disposed of finally permitting the petitioner to submit a fresh representation ventilating all her grievances as has been raised in the present petition before the respondent no. 3/Regional Deputy Director, Secondary Education, Aligarh Region, Aligarh within a period of three weeks from today. If such representation is made, the respondent no. 3 is directed to take a decision in the matter most expeditiously and preferably within a period of six weeks thereafter.
