HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 34

Petitioner :- Mateen Ahmad

Respondent :- State Of U.P. And 2 Others

Counsel for Petitioner :- Atul Kumar Tiwari

Counsel for Respondent :- C.S.C.

Hon'ble Saurabh Shyam Shamshery,J.

Petitioner's arms license was cancelled on the ground of pendency of three criminal cases. Appeal thereof was also rejected.

It is not in dispute that at that time three criminal cases were pending against petitioner. Subsequently, either Final Report was submitted or he has been granted acquittal.

Since the petitioner is relying upon subsequent events, therefore, impugned order cannot become illegal. Therefore, without interfering with impugned order, this writ petition is disposed of and petitioner is at liberty to file a fresh application and the application will be considered in term of Arms Act and Rules framed thereunder along with details of subsequent events and licensing authority will consider case of the petitioner in accordance with law taking note of judgment passed by this Court in Indrajeet Singh Vs. State of U.P. & Others, 2021 (10)ADJ 471.
