This appeal has been filed against judgment and order dated 23.6.1990, passed by Ist Additional District and Sessions Judge, Muzaffarnagar, in Sessions Trial No.130 of 1988, wherein the accused appellant has been convicted and sentenced to life imprisonment under Section 302 IPC.

A letter has been received from the Chief Judicial Magistrate, Muzaffarnagar, stating that the sole appellant Meer Mohmamad has died 20 years ago. Documents in that regard have been annexed alongwith the communication of the Chief Judicial Magistrate, Muzaffarnagar.

Since the appellant has already died during the pendency of appeal, as such this appeal abates and is, accordingly, dismissed.
