This appeal is listed in the category of cases which are likely to be abated on account of death of the appellant.

This appeal has been filed against judgment and order dated 28.1.1986, passed by IIIrd Additional Sessions Judge, Etah, in Sessions Trial No.265 of 1983 connected with Sessions Trial No.526 of 1983, wherein the accused appellant has been convicted and sentenced to life imprisonment for offence under Section 302, 148 IPC.

A letter has been received from the Chief Judicial Magistrate, Etah, stating that the sole appellant Mohendra Singh son of Lakhan Singh has died on 29.6.2022 due to old age complications. Documents in that regard have been annexed alongwith the communication of the Chief Judicial Magistrate, Etah.

Since the sole appellant has already died during the pendency of appeal, as such this appeal abates and is, accordingly, dismissed.
