1. Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal despite the fact that there are four learned counsels appearing on behalf of the appellant. Sri Ajay Singh, learned A.G.A-I for the State is present. Sri Amit Daga, Advocate appears on behalf of the first informant and states that his name is wrongly printed in the cause list as learned counsel for the appellant.
2. The present appeal has been preferred by the appellant against the judgment and order dated 21.3.2006 passed by Addl. Sessions Judge, Court No.11, Muzaffarnagar in S.T. No.1002 of 2004 (State Vs. Amit Kumar and others).
3. As per the office report dated 29.11.2023, a report of C.J.M., Muzaffarnagar dated 21.8.2023 has been received stating therein that the sole appellant Amit Kumar has died on 28.6.2022. The said report has been sent after due inquiry.
4. This Court has perused the said report which states that the accused-appellant has died.
5. In view of the above, the appeal stands abated.
6. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order to the District and Sessions Judge, concerned within two weeks from today.
