1. Heard learned counsel for the petitioner and perused the record.

2. It is argued that revision was filed by the opposite party (tenant) against the judgment and decree dated 09.09.2016 passed by the Civil Judge (Junior Division), Jalaun in the year 2016 which was numbered as J.C.R. No. 4 of 2016 (Yaqoob Baig vs. Bal Krishna & others). It is argued that the same is pending consideration before the Additional District & Sessions Judge, Court No.1, Jalaun at Orai since 2016.

3. In view of the order proposed to be passed herein, no useful purpose would be served by putting the respondent to notice and keeping this petition pending before this Court. However, in case the respondent feels aggrieved by the order his right to seek modification/variation of the order is being kept reserved.

4. In the facts and circumstances of the case, the present petition is disposed of finally directing the court concerned to decide the aforesaid case strictly in accordance with law most expeditiously and preferably within a period of six months but without granting any unnecessary adjournment unless there is no legal impediment.
