1. Heard Shri Alok Kr. Mishra, learned Counsel for the appellant and Shri Ran Vijay Singh, learned Counsel for the respondents.

2. This intra-court appeal is directed against the judgment/order dated 07.08.2023 passed in Writ-A No.5195 of 2023 whereby the writ petition filed by the appellant-petitioner seeking writ of mandamus to relieve her pursuant to the transfer order has been dismissed.

3. The impugned order itself shows that the appellant-petitioner had undertaken to participate in the pending inquiry and on conclusion of the same, she was to be relieved for joining at the transferred place.

4. Shri Ran Vijay Singh, learned Counsel for the respondents has submitted that even after passing of the order dated 07.08.2023, the appellant-petitioner has not participated in the ongoing inquiry and has rather proceeded on leave.

5. In view of the above, we permit the appellant-petitioner to participate in the ongoing inquiry within ten days henceforth. On conclusion of the inquiry, the appellant-petitioner shall be relieved.

6. The special appeal is, accordingly, disposed of.
