Heard learned counsel for the petitioner, learned counsel appearing for the respondent no. 1 and Sri Gyanendra Kumar Srivastava, learned counsel for the respondents no. 3 & 4.

Issue notice to the respondent no. 2 returnable at an early date.

Steps be taken within a week.

All the respondents may file counter affidavit within four weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.

As regards the interim relief application, Sri Gyanendra Kumar Srivastava, learned counsel for the respondents no. 3 & 4 points out that this aspect of the matter has already been considered by this Court in Writ-C No. 6417 of 2023 Inre; Baba Vishwanath Shivphool Shikshan Sewa Sansthan Thru Manager Sumit Singh and Anr Vs. State of U.P and 4 Ors vide order dated 09.08.2023 wherein after considering the judgment of Apex Court in the case of State of Uttarakhand Vs. Nalanda College of Educations and Ors reported in (2022) SCC OnLine SC 1553, the interim relief application been rejected.

Learned counsel for the petitioner has been unable to persuade the Court to take a different view from that as taken by this Court earlier vide order dated 09.08.2023.

Considering the aforesaid, the interim relief application is rejected.
