1. Sri Pradeep Kumar Rai appearing on behalf of Sri Kamal Krishna, learned counsel for the appellant and Sri Triveni Sharan Rai, learned counsel for the State are present.

2. The present appeal under section 374(2) Cr.P.C. has been preferred by the appellant against the judgment and order dated 06.07.2006 passed by Additional District and Sessions Judge/Fast Track Court No. 3, Ghazipur in Session Trial No. 520 of 2004.

3. As per the office report dated 21.07.2023 a report of CJM concerned dated 12.07.2023 has been received stating therein that the sole appellant has died. The said report has been sent after due inquiry.

4. This Court has perused the said report which states that the accused-appellant have died.

5. In view of the same, the appeal stands abated.

6. File consigned to records.

7. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
