Heard learned A.G.A. and perused the record.

This criminal revision has been filed against the judgement and order dated 24.02.2009 passed by Additional Sessions Judge/F.T.C., Court No. 2, Agra in Session Trial No. 362 of 1999 (State Vs. Sanjay Singh and another) whereby the respondent nos. 1 and 2 were acquitted under Sections 307/34 I.P.C.

Learned A.G.A. submits that trial court has considered all the aspect relating to the matter and has passed the impugned judgement in right perspective. Thus, the revision is liable to be dismissed.

Perusal of the impugned judgment goes to show that, learned court below has considered the oral as well as documentary evidence and has appreciated the evidence available on record in a rightful manner. The trial court has also recorded its reason while acquitting the respondent nos. 1 and 2. The impugned judgement and order does not suffer from any illegality or jurisdictional error so as to warrant interference in exercise of revisional jurisdiction. More so, the revisionist is not present to press this revision even in the revised calls.

The criminal revision, is accordingly, dismissed both for want of prosecution as well as on merits.

Interim order, if any, stands vacated.

However, revisionist shall be at liberty to file recall/restoration application in case any cause of action survives.
